Is This the End of Executive Privilege? Or Only for Trump?

· What if Obama had been called by a congressional committee to turn over all internal communications — written and oral — regarding his decision, and he claimed executive privilege? And what if then President Trump were to have waived Obama's privilege?
· One thing we know to be certain: many of the academic "experts" and media "pundits" who now support the argument that an incumbent president can waive the executive privilege of his predecessor would be making exactly the opposite argument. They would be saying — as I am saying now— that presidents would be reluctant to have confidential communications with their aides if they knew these communications could be made public by their successor in order to gain partisan electoral advantage. It would essentially mark the end of executive privilege, which is rooted in Article II of the Constitution.
· Accurate predictions today require us to know which persons or parties will be helped or hurt by particular outcomes. Hypocrisy reigns. And those who engage in it are not even embarrassed when their double standards are exposed. The current "principle" is that the ends justify the means, especially if the end is the end of Trump.
· "Because we can" has become the current mantra of both parties. Neutral principles, which apply equally without regard to partisan advantage, is for wimps, not party leaders or other government officials. "They do it too" has become the excuse de jure. Both parties do it, but that is not a valid excuse even in hardball politics. Two constitutional violations do not cancel each other. They only make things worse.
· Executive privilege is important to both parties -- and to the constitutional rule of law. Today's partisan victory for Democrats, if their waiver argument is accepted, will soon become their loss should Republicans take control.
· So beware of what you wish for. Today's dream may well become tomorrow's nightmare.

In its appeal from Judge Aileen Cannon's order appointing a special master, the Biden administration is taking the position that the incumbent president can waive claims of executive privilege by his predecessor even if his predecessor is likely to run against him in the next election. So, let's see how this would have played out if the shoe were on the other foot.

Imagine if President Donald Trump had tried to waive his predecessor's executive privilege, relating to President Barack Obama's decision to allow the United Nations Security Council to condemn Israel for its continuing "occupation" of the Western Wall and the roads to Hebrew University and Hadassah Hospital. Many in the Obama administration opposed this one-sided resolution as anti-Israel and wanted the United States to veto it, as it had vetoed previous anti-Israel resolutions. But Obama instructed his UN representative, Samantha Powers, not to veto it.

Trump knew he would be running against Obama's vice president and that he might gain an electoral advantage if Congress held hearings on the controversial Obama decision. What advice did Biden give Obama? Is it true that Powers wanted to veto the resolution, but Obama forbade it in order to take revenge against Israeli Prime Minister Benjamin Netanyahu for his speech opposing the Iran deal?

Disclosing these privileged negotiations might well have hurt Biden with pro-Israel voters.

The weaponization of the Constitution and the law for partisan advantage has become so pervasive, especially in academia and the media, that predicting what position many experts and pundits will take is no longer possible on the basis of neutral principles or precedents, since these have ceased to be the basis for their positions. Accurate predictions today require us to know which persons or parties will be helped or hurt by particular outcomes. Hypocrisy reigns. Nor are Democrats the only guilty party. Perhaps the most blatant example of partisan hypocrisy was how the Republican Senate treated the 2016 nomination of Merrick Garland and the 2020 nomination of Amy Coney Barrett as Supreme Court justices. The Republicans refused to give Garland a hearing in 2016, because it was too close to the election, but then rushed through the nomination of Barrett just weeks before the 2020 election. Whenever asked to justify their obvious double standard, their only response was "because we can."

BALTIMORE -- A Danish ship and a U.S. Navy vessel collided in Baltimore's Inner Harbor on Sunday morning, according to authorities.

The "Danmark" was being tugged by a smaller boat when it smashed into some wood pilings a few minutes after 11 a.m., officials said.

The tugboat then pulled the Danmark into the U.S. Minneapolis-St. Paul, according to authorities.

U.S. military personnel said in a statement facilitated by the Baltimore Police Department that no one was injured during the collision.

"No U.S. Navy personnel were injured and no serious damage sustained onboard USS Minneapolis St. Paul (LCS 21) when the Danish training ship Danmark made contact with the moored LCS while the Danish ship was getting underway from the Baltimore Inner Harbor Sept 11, 2022," a U.S. Navy spokesperson said. "The ships were in port taking part in what has been a fantastic week in Baltimore for Maryland Fleet Week and Flyover Baltimore." [CBS News]

Modern slavery is on the rise, and it looks like the COVID-19 pandemic played a role in the uptick.

These numbers are frightening.

Nearly 50 million people were living in some form of modern slavery last year, either through forced labor or a forced marriage, an increase of 10 million more people from 2016, according to the United Nations's International Labour Organization (ILO) and International Organization for Migration (IOM).

The United Nations published the study this month with anti-slavery organization Walk Free, finding that close to 28 million people were in forced labor in 2021 and nearly 22 million were in a forced marriage, which translates to about 1 in every 150 people worldwide.

10 million additional modern-day slaves in just five years. That's not cool. And that number, "1 in ever 150 people" living in modern-day slavery, that really puts this in perspective.

So sad.

A highly politicized Federal agency, the FBI, is using its government authority to brazenly harass and bully the American people by searching comment sections of online content, raiding people’s homes, using the corporate media to smear the political opponents of the Democrat-RINO machine, to drag Conservatives around courts, and to scare people away from participating in civic, political activism.

Specially to push people away from activism dealing with the Dominion election system, and President Donald J. Trump responded with a call to action for voters all over the United States.

There is no better example of the lengths the FBI will go to punish Americans than the story of Gold Star Mom, Tina Peters, a former election official in Colorado, who has told media that she grew concerned about the integrity of elections in the state after activists convinced her that investigation was needed into the 2020 elections and the machines that counted the vote in that state.

Peters, whose courageous story has been highlighted by My Pillow CEO, Mike Lindell, was made into a moving documentary about one Mother’s heroic tribute to her dead son’s patriotic service to America - by continuing his legacy to serve the American people.

According to local Colorado news about Peters’ case, things are really heating up:

“Mesa County Clerk and Recorder Tina Peters have pleaded not guilty to charges related to a security breach of her office’s election equipment.

Peters was in court Wednesday afternoon for her arraignment after being charged earlier this year. A trial date is set for March 6, 2023.

Peters is accused of helping an unauthorized person make copies of sensitive voting machine hard drives and attend an annual software update. Information from the machines and photos of their passwords were later shared with election conspiracy theorists online.”

Lindell has been a champion of both Peters and the American public who are demanding answers to the highly suspicious vote tallying machines.

Yahoo News reported on recent developments where Lindell is not being targeted by having his phone seized while he was out and unable to make a download of his important digital information, reporting:

“MyPillow chief executive Mike Lindell said Tuesday that federal agents seized his cellphone and questioned him about a Colorado clerk who has been charged in what prosecutors say was a “deceptive scheme” to breach voting system technology used across the country.

Lindell was approached in the drive-thru of a Hardee’s fast-food restaurant in Mankato, Minnesota, by several FBI agents, he said on his podcast, “The Lindell Report.” The agents questioned him about Dominion Voting Systems, Mesa County Clerk Tina Peters and his connection to Doug Frank, an Ohio educator who claims voting machines have been manipulated, he said.

The agents then told Lindell they had a warrant to seize his cell phone and ordered him to turn it over, he said. On a video version of his podcast, Lindell displayed a letter signed by an assistant U.S. attorney in Colorado that said prosecutors were conducting an “official criminal investigation of a suspected felony” and noted the use of a federal grand jury.

The circumstances of the investigation were unclear. The Justice Department did not immediately respond Tuesday night to a request for comment about the seizure or investigation.

“Without commenting on this specific matter, I can confirm that the FBI was at that location executing a search warrant authorized by a federal judge,” FBI spokeswoman Vikki Migoya said in an email.

Federal prosecutors have been conducting a parallel investigation alongside local prosecutors in Colorado who have charged Peters with several offenses, including attempting to influence a public servant, criminal impersonation and official misconduct. The Republican was elected in 2018 to oversee elections in Colorado’s Mesa County. A deputy clerk, Belinda Knisley, was also charged in the case, pleaded guilty and was sentenced to two years of probation.

Earlier Tuesday, the FBI seized Mike Lindell’s phone.

The FBI trailed Mike Lindell and pulled up on him at a Hardee’s.

Biden called out American patriots as a clear and present danger to the nation.
